Terms of Service

These Terms of Service ("Terms") govern your access to and use of the EstateCam mobile app and related services (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

EstateCam is a mobile application for capturing, uploading, and processing real-estate photography, including guided HDR bracket capture and delivery of edited results. We may add, change, or remove features at any time.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

3. Accounts and Guest Use

You may use the Service as a guest or by signing in. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

4. Company Codes

Certain features are unlocked using a company code provided by a company you work with or for. You agree to use company codes only with authorization. Uploads made under a company code may be associated with and delivered to that company.

5. Your Content

You retain ownership of the photos and other content you capture or upload ("Your Content"). You grant us a limited, non-exclusive, worldwide license to host, store, process, reproduce, and modify Your Content solely as necessary to operate and provide the Service to you and your company.

You represent that you have all rights necessary to upload Your Content and to grant this license, and that Your Content does not infringe the rights of any third party or violate any law.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful, infringing, or harmful purpose.
  • Upload content you do not have the right to upload, or content that is illegal, abusive, or violates the privacy of others.
  • Attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the Service or its systems.
  • Use company codes or accounts that do not belong to you, or misrepresent your affiliation.

7. Intellectual Property

The Service, including its software, design, and branding, is owned by us and our licensors and is protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights in the Service.

8. Third-Party Services

The Service relies on third-party providers (such as authentication, cloud storage, and image-processing services) and may link to third-party content. We are not responsible for third-party services, and your use of them may be subject to their own terms.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, EstateCam and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws applicable in the jurisdiction in which EstateCam operates, without regard to conflict-of-law principles.
